Arrears are any missed or underpaid mortgage payments. Even one missed payment can trigger a default notice. The longer arrears continue, the more fees and interest accumulate — and the more difficult it becomes to resolve.
Most lenders begin possession proceedings after three to six months of arrears, though this varies. Some lenders act faster — particularly specialist or buy-to-let lenders. The important thing is not to wait for formal letters before taking action.
It is difficult but not always impossible. High street lenders will typically decline applications with recent arrears. Some specialist lenders may consider it, though rates will be significantly higher. A remortgage also takes time — which may not be available if proceedings have already started.
A contracted sale to a principal buyer with proof of funds and a fixed completion date can be presented to the court as grounds to stay (pause) proceedings. Our Rescue Certificate is designed for exactly this purpose. In most cases, proceedings are paused once a formal sale is in place.
